Pedestrian accident questions — answered
Do pedestrians always have the right of way in California?
Not always — but drivers always owe pedestrians care. Vehicle Code §21950 requires drivers to yield at marked and unmarked crosswalks, and even when a pedestrian steps out unexpectedly, drivers must exercise due care for anyone on the road. Pedestrians have their own duty not to step suddenly into traffic, which is exactly where insurers try to shift blame.
What if the driver who hit me fled the scene?
You may still have a claim. Report the hit-and-run to police immediately and get medical care — then look at uninsured motorist coverage, which applies to you as a pedestrian if you or a household family member carries it on an auto policy. Many people are covered this way and have no idea. We check for every policy that might respond.
Can I recover if I was jaywalking?
Possibly, yes. California’s pure comparative negligence rule means crossing outside a crosswalk reduces your recovery by your share of fault — it does not eliminate the claim. And since the Freedom to Walk Act took effect in 2023, safe mid-block crossing is no longer even a citable offense. The driver’s speed, attention, and opportunity to avoid you all still count.
