Riverside Wrongful Death Attorney
For families carrying the heaviest loss — with care and resolve.
No case result gives a family back what they lost. What a wrongful death claim can do is hold the responsible party accountable and protect the family’s future — funeral costs, lost financial support, and the loss of companionship California law recognizes.
These cases have their own rules about who may file and strict deadlines that can be shorter than families expect. Our team guides spouses, children, and parents through the process with the care it demands — and the resolve it deserves.

Questions families ask — answered with care
Who can file a wrongful death claim in California?
California Code of Civil Procedure §377.60 gives the right first to the surviving spouse or domestic partner and the children. If there are none, the claim passes to whoever would inherit under intestate succession — often parents or siblings. Certain financial dependents, including a putative spouse or stepchildren, may also qualify. Sorting out who may file is often a family’s first legal question, and we walk through it at no charge.
What is the statute of limitations for wrongful death in California?
Generally two years from the date of death, under Code of Civil Procedure §335.1. When a public entity is involved — a government vehicle, a dangerous public road — a formal claim is usually required within six months. Cases arising from medical care follow their own rules. Because the deadline runs from the death, not the injury, families should confirm their dates early.
What damages can a family recover in a wrongful death case?
California recognizes both the economic and the human loss: funeral and burial costs, the financial support and household contributions the person would have provided, and the loss of their companionship, protection, and guidance. A separate “survival” claim can recover certain losses the person suffered before death. No result restores what was lost — but the law is built to protect the family’s future.
What if a government vehicle or a dangerous road was involved?
The deadline drops from two years to six months. Under the Government Claims Act (Government Code §911.2), a wrongful death claim against a city, county, Caltrans, a transit agency, or any other California public entity must first be presented as a written claim to that entity within six months of the death — a lawsuit cannot be filed until the claim is presented and rejected, and the rejection starts its own six-month clock. This applies to a crash with a city truck or a sheriff’s vehicle, a collision caused by a missing guardrail or a signal that failed, and a death on a public bus. Families rarely know a public entity was involved until someone looks; we look in the first week.
Our loved one died at the hospital after the crash. Does that change the case?
It adds a second set of records and a second claim, not a second obstacle. Most fatal Inland Empire crashes end at one of three trauma centers — Riverside Community Hospital, Arrowhead Regional in Colton, or Loma Linda University Medical Center — and the hospital record, the coroner’s report, and the crash report together establish both the wrongful death claim and the survival claim for what the person endured before death. We collect all of it, in the language the family speaks, and we handle the calls the family should not have to take.
