How does Uber and Lyft insurance work after an accident?
Coverage depends on what the app was doing at the moment of impact. App off: only the driver’s personal auto policy applies. App on and waiting for a request: Uber and Lyft provide limited liability coverage. En route to a pickup or during a trip: a $1 million commercial liability policy applies, often alongside uninsured/underinsured motorist coverage. Pinning down the period — and the policy — is the first real work in these claims.
Can I sue Uber or Lyft directly, or just the driver?
In most California cases the practical path runs through the insurance coverage Uber and Lyft are required to carry, rather than a lawsuit against the company itself, because drivers are classified as independent contractors. There are exceptions, and the answer can shift with the facts of your crash. What matters for your recovery is making the commercial policy — not just the driver’s personal one — respond.
What if I was a passenger in the Uber or Lyft?
Passengers are in the strongest coverage position: during a trip, the $1 million commercial policy applies no matter which driver caused the crash, and the claim can also reach the other vehicle’s insurer. Don’t assume the companies handle it fairly on their own — passengers get lowballed like everyone else, and the app’s crash report is not a claim.
