Are personal injury settlements taxable in California?
Generally, no. Under federal law — IRC §104(a)(2) — and California’s conforming rules, compensation for physical injuries or physical sickness is not taxable income, whether the money comes from a car accident settlement or a wrongful death case. There are exceptions: punitive damages, interest, and amounts for emotional distress unconnected to a physical injury can be taxed. Every settlement is structured differently, so confirm the details with a tax professional before you spend or invest it.
What is pure comparative negligence in California?
It is the rule that being partly at fault reduces your recovery instead of eliminating it. A person found 30% responsible for a crash still recovers 70% of their damages — and California applies this with no cutoff, unlike states that bar recovery at 50% fault. In practice, the fault percentage is one of the most negotiated numbers in a car accident claim, because insurers propose splits the evidence does not support.
Can I claim emotional distress after a car accident in California?
Yes. California allows recovery for the emotional harm an accident causes — anxiety, sleeplessness, fear of driving — as part of pain-and-suffering damages in an injury claim. These damages are real but invisible, so they turn on documentation: what you tell your doctors, a therapist’s records, and how the change shows up in your daily life.
